Claims
Insurer's default interest
Surcharge imposed by law on the insurer who does not pay or deposit the compensation on time: the legal interest increased by fifty percent and, after two years, never less than twenty percent.
In practice
It is the most effective tool against a file that is prolonged without reason. It accrues from the date of the claim, not from the claim submission, and therefore time plays in favour of the insured when the cover is clear.
Where it is addressed
This term is covered in Siniestros and applies when taking out Gestión de Siniestros.
